Victims’ Rights in the Diversion Landscape

چکیده

In this piece I explore the practical and theoretical conflicts that might surface when diversion movement victims’ rights intersect. focus on two possible sites of tension: victim input into offer victim’s right to receive restitution as a term diversion. Protocols give victims greater voice in justice process have been mainstay burgeoning for past several decades, but argue those protocols must be understood within (and thus limited by) context fiscal responsibility, compassion offender, proportionality system lie at heart schemes. Any other arrangement risks elevating retribution over rehabilitation inserts level arbitrariness would subvert our commitment fairness transparency.
